Terms & Conditions

Last updated: 22 August 2026 · Applies to gimahealth.com and all services offered by Global India Medical Assistance Health

In short: Global India Medical Assistance Health is a patient facilitation and coordination service. We are not a hospital, we do not employ doctors, and we do not perform medical treatment. We help you find the right hospital and recovery centre in India, coordinate logistics, and support you throughout — but the contract for medical treatment is always between you and the treating hospital directly.

1.Introduction & Acceptance

These Terms and Conditions ("Terms") govern your access to and use of the website gimahealth.com (the "Site") and all services offered by Global India Medical Assistance Health ("we", "us", or "our"), a patient facilitation and medical tourism coordination service based in New Delhi, India.

By accessing the Site, submitting an enquiry, communicating with us over WhatsApp, email or phone, or engaging our services in any way, you ("you", "the User", "the Patient", or "the Client") agree to be bound by these Terms. If you do not agree with any part of these Terms, please do not use the Site or our services. If you are enquiring or engaging on behalf of a family member or another individual, you confirm that you are authorised to do so and to accept these Terms on their behalf.

2.Definitions

  • "Services" means the patient facilitation, coordination, logistics, and advisory services provided by Global India Medical Assistance Health, including but not limited to hospital and doctor matching, cost estimation, travel and visa assistance, and coordination of recovery-centre stays.
  • "Partner Hospital" or "Treating Hospital" means any independent, third-party hospital or clinic in India to which we refer or introduce you for medical treatment.
  • "Recovery Centre" means any independent, third-party wellness, Ayurveda, or recovery facility in India to which we refer or introduce you for post-treatment recovery.
  • "Package" means an indicative bundle of treatment, recovery, and logistics services described on the Site, the final scope and price of which is confirmed in writing prior to any commitment.

3.Nature of Our Services

Global India Medical Assistance Health is not a hospital, clinic, medical practice, or healthcare provider. We do not employ, supervise, or control any doctor, surgeon, nurse, therapist, or other medical or wellness professional. Our role is limited to:

  • Reviewing the information and medical records you provide and referring you to a Partner Hospital and doctor we believe may be suitable for your condition;
  • Requesting indicative cost estimates from Partner Hospitals and Recovery Centres on your behalf;
  • Assisting with travel logistics, accommodation coordination, interpreter arrangements, and general support during your visit to India;
  • Acting as a point of contact and coordinator between you, the Treating Hospital, and the Recovery Centre before, during, and after your treatment.

All medical consultations, diagnoses, procedures, surgeries, prescriptions, and treatments are performed exclusively by the Treating Hospital and its independent medical staff, under a separate direct contractual and doctor-patient relationship between you and that hospital. Similarly, all wellness and Ayurvedic therapies are administered exclusively by the Recovery Centre's own qualified staff, under a separate agreement between you and that centre. Global India Medical Assistance Health is not a party to, and accepts no responsibility for, the medical treatment contract or the recovery-centre services contract.

4.No Medical Advice or Diagnosis

Nothing on the Site, in our marketing materials, or in any communication from Global India Medical Assistance Health (including WhatsApp, email, or phone conversations with our coordinators) constitutes medical advice, diagnosis, or a treatment recommendation. Any general information we share about specialties, procedures, or recovery timelines is for planning purposes only and must not be relied upon as a substitute for professional medical consultation. You must independently discuss your diagnosis, treatment options, risks, and prognosis directly with the doctors at the Treating Hospital before consenting to any procedure.

5.Eligibility & Your Obligations

By using our Services, you confirm that you are at least 18 years of age, or are using the Services on behalf of a minor or dependent as their parent, legal guardian, or authorised representative. You agree to:

  • Provide accurate, complete, and current medical history, records, and personal information;
  • Promptly disclose any change in your medical condition prior to travel or treatment;
  • Comply with all instructions given by the Treating Hospital and Recovery Centre;
  • Comply with the immigration, customs, and visa laws of India and your home country;
  • Bear sole responsibility for the accuracy of information you provide, as incomplete or inaccurate medical history may affect hospital assessment, cost estimates, or treatment safety.

6.Third-Party Hospitals & Recovery Centres

Partner Hospitals and Recovery Centres named on the Site or recommended to you are independent third-party entities and are not owned, operated, staffed, or controlled by Global India Medical Assistance Health. We select them based on publicly available information, their stated accreditations, and their track record with international patients, but we do not guarantee, warrant, or accept liability for:

  • The quality, safety, or outcome of any medical treatment, surgery, or therapy provided;
  • Any act, omission, negligence, or malpractice by any doctor, hospital staff, or recovery-centre staff;
  • The accuracy of any accreditation, certification, or claim made by a Partner Hospital or Recovery Centre;
  • Changes to a Partner Hospital's or Recovery Centre's pricing, availability, or policies.

Any claim relating to medical negligence, malpractice, or the standard of care received must be brought directly against the Treating Hospital or Recovery Centre concerned, and not against Global India Medical Assistance Health.

7.Fees, Payments & Currency

Package prices displayed on the Site are indicative starting ranges only, shown in US Dollars for planning purposes, and are subject to change based on your specific diagnosis, procedure complexity, chosen hospital, room category, and length of stay. A final, itemised written quotation will be provided before you make any payment or commitment. Hospital and treatment fees are typically payable directly to the Treating Hospital, in the currency and instalments it specifies. Any coordination, concierge, or facilitation fee charged directly by Global India Medical Assistance Health will be disclosed to you separately and in advance. You are responsible for any bank charges, currency conversion fees, or transfer costs incurred in making payments.

8.Cancellations & Refunds

Cancellation and refund terms for hospital deposits and treatment fees are governed by the individual policies of the Treating Hospital or Recovery Centre concerned, which will be shared with you in writing at the time of booking. Any coordination or facilitation fee paid directly to Global India Medical Assistance Health is refundable only to the extent that the corresponding service has not yet been performed, at our reasonable discretion, unless otherwise agreed in writing. We are not liable for losses arising from cancellations, postponements, or changes made by a Partner Hospital or Recovery Centre.

9.Visa, Travel & Documentation

We may assist you in understanding and applying for an Indian Medical Visa (M-Visa) or Medical Attendant Visa (MX-Visa), including liaising with the Treating Hospital for an invitation letter. However, the decision to grant or refuse a visa rests solely with the relevant Indian consulate, embassy, or immigration authority, and Global India Medical Assistance Health has no control over and accepts no liability for visa delays, refusals, or changes in immigration policy. You are responsible for ensuring your passport, visa, travel insurance, and other documentation are valid and in order. We strongly recommend purchasing comprehensive travel and medical insurance before travelling to India.

10.No Guarantee of Outcomes

Medical and surgical treatment carries inherent risk. Global India Medical Assistance Health makes no representation, warranty, or guarantee, express or implied, regarding the outcome, success, safety, or suitability of any treatment, procedure, or therapy undertaken at a Partner Hospital or Recovery Centre. Testimonials, case studies, or illustrative content on the Site (including photographs and video) represent general information about the type of care and settings involved and do not represent a specific patient, outcome, or guarantee of similar results.

11.Data Protection & Privacy

In the course of providing our Services, we collect and process personal and sensitive medical information you share with us, including medical reports, diagnostic results, and identification documents. We will:

  • Use this information solely to facilitate your treatment and recovery coordination, including sharing relevant medical information with the Treating Hospital and Recovery Centre for the purpose of assessing and providing your care;
  • Take reasonable technical and organisational measures to keep your information confidential and secure, consistent with the Information Technology Act, 2000 and applicable data protection rules in India;
  • Not sell your personal or medical information to third parties for marketing purposes;
  • Retain your information only for as long as reasonably necessary to provide the Services and to comply with legal or regulatory obligations.

By submitting your medical records and personal information to us, you consent to this collection, use, and limited sharing as described above and as necessary to coordinate your care.

12.Intellectual Property

All content on the Site, including text, graphics, logos, and the Global India Medical Assistance Health name and mark, is the property of Global India Medical Assistance Health or its licensors and is protected by applicable intellectual property laws, except for hospital and recovery-centre names, logos, and imagery, which remain the property of their respective owners and are used solely to describe our coordination network. You may not reproduce, distribute, or create derivative works from the Site's content without our prior written consent.

13.Limitation of Liability

To the fullest extent permitted by applicable law, Global India Medical Assistance Health, its directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of life, personal injury, medical complications, loss of income, or emotional distress, arising out of or in connection with:

  • Any medical treatment, surgery, or therapy provided by a Partner Hospital or Recovery Centre;
  • Any act, error, omission, or negligence of a Partner Hospital, Recovery Centre, or their staff;
  • Visa delays or refusals, flight or travel disruptions, or events outside our reasonable control;
  • Your reliance on general information provided on the Site or by our coordinators.

Where liability cannot be excluded under applicable law, our total aggregate liability to you for any claim arising from our Services shall not exceed the amount of coordination or facilitation fees actually paid by you to Global India Medical Assistance Health directly (excluding amounts paid to any Partner Hospital or Recovery Centre).

14.Indemnification

You agree to indemnify and hold harmless Global India Medical Assistance Health, its directors, employees, and agents from and against any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising out of your breach of these Terms, provision of inaccurate or incomplete medical information, or violation of any law or third-party right.

15.Force Majeure

Global India Medical Assistance Health shall not be liable for any failure or delay in performing our obligations where such failure or delay results from circumstances beyond our reasonable control, including but not limited to natural disasters, pandemics or public health emergencies, government action, travel restrictions, strikes, or hospital or recovery-centre closures.

16.Termination

We may suspend or discontinue providing Services to you at our discretion, including where you provide false information, engage in abusive conduct towards our staff or partners, or where continuing to assist you would place you or others at risk. You may discontinue engaging our Services at any time by notifying us in writing; any fees already paid to Partner Hospitals or Recovery Centres will be governed by their own cancellation policies.

17.Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law principles. Subject to Section 18 below, the courts at New Delhi, India shall have exclusive jurisdiction over any dispute arising out of or relating to these Terms or our Services.

18.Dispute Resolution

In the event of any dispute, controversy, or claim arising out of or relating to these Terms or our Services, the parties shall first attempt to resolve the matter amicably through good-faith negotiation for a period of thirty (30) days. If the dispute is not resolved within this period, it shall be referred to and finally resolved by arbitration in New Delhi, India, in accordance with the Arbitration and Conciliation Act, 1996, conducted in English by a sole arbitrator mutually appointed by the parties. This clause does not affect your statutory rights under the Consumer Protection Act, 2019 to approach a consumer forum where applicable.

19.Severability & Entire Agreement

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect. These Terms, together with any written quotation or service agreement issued to you, constitute the entire agreement between you and Global India Medical Assistance Health regarding our Services, superseding any prior understanding or agreement, whether oral or written.

20.Changes to These Terms

We may update these Terms from time to time to reflect changes in our Services or applicable law. The updated Terms will be posted on this page with a revised "Last updated" date. Continued use of the Site or our Services after such changes constitutes your acceptance of the revised Terms.

21.Referral Programme

Through our "Help Someone You Love" referral form, you may refer a person you know to us for consideration. If the person you refer subsequently begins treatment coordinated by Global India Medical Assistance Health, we will pay you a one-time referral reward of USD $200. No reward is payable for the referral alone — it becomes due only once the referred person's treatment is confirmed and has commenced with a partner hospital. We may verify the referral relationship, decline duplicate, self-directed or fraudulent referrals, and vary or discontinue this programme at any time without prior notice. You are responsible for any taxes or transfer costs applicable to the reward in your jurisdiction.
